Canadian govt funds disgraced judge

Issue No: 788; 23 May 2001

The Canadian government is funding the trip of disgraced judge Justice Daniel Fatiaki to a training program in Canada.

Justice Fatiaki was involved in providing advice to the President on abrogating the 1997 Constitution, dismissing an elected government and appointment of a caretaker government. Later he was involved in suppressing evidence in a case involving an application for him to disqualify himself from hearing a case involving the Constitution and the actions of the President.

It is understood that the Canadian aid office in Suva had declined the request for the funding, but the New Zealand office approved the funds.

The Citizens Constitutional Forum has written to the Canadian government asking it to reconsider funding the disgraced judge's trip.

Justice Fatiaki is to attend an Intensive Study Programme for Judicial Educators at Halifax in Canada from 27 May to 15 June.

Meanwhile at least one media organisation has questioned the relevance of the program to the senior judge, saying a junior officer should have been nominated.
