Regime throws spanner in Constitutional case

The Qarase regime has thrown a spanner in the Constitutional challenge on the legality of the Qarase regime.

The Citizens Constitutional Forum (CCF) has challenged the legality of the President's decision to reappoint Laisenia Qarase as Prime Minister despite the Fiji Court of Appeal ruling that the Constitution was still the supreme law of the country.

Yesterday judge Michael Scott suggested that instead of a single judge hearing a constitutional case, a panel of 3-judges should hear it in a specially convened Constitutional Court.

The CCF wants the court decision to be made before 12 July as the writ for the new election are to be taken out around 12 July.

Scott also decided to reject 2 more affidavits from the plaintiffs.

Scott was one of the 3 judges who participated in advising the now deposed President on dismissing the elected Prime Minister, dissolving the Parliament and abrogating the Constitution. The CCF had earlier called for the sacking of the three.
